TERMS AND CONDITIONS

1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of approached.au and any product, service, or program delivered by Approached ("we", "us", "our", "Approached"), including The Audit, The Positioning Report, The Early Approach newsletter, The Playbook, The Cohort, and The Advisory (collectively, the "Services").
By accessing the website, taking The Audit, claiming The Positioning Report, subscribing to The Early Approach, or purchasing any paid product or service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access the website or use the Services.
2. Definitions
In these Terms:
"You" means the individual accessing the website or purchasing a Service.
"The Audit" means The Approached Audit, a free 12-question diagnostic scorecard.
"The Positioning Report" means a free personalised review of your LinkedIn and resume by Cheraine, delivered on a first-come basis.
"The Early Approach" means the free email newsletter delivered approximately weekly.
"The Playbook" means the self-paced six-module course delivered through the Kajabi platform, sold at a founding-member price of 1,000 AUD (rising to 1,500 AUD after 100 founding-member buyers).
"The Cohort" means the cohort-based program comprising The Playbook plus weekly live sessions and async chat with Cheraine and senior peers, sold at 4,000 AUD.
"The Advisory" means the 1:1 done-for-you engagement comprising positioning, LinkedIn rebuild, resume rebuild, target list, outreach drafting, and conversation booking, sold at 8,000 AUD with optional payment plan.
"Cheraine" means Cheraine, founder of Approached.
"Materials" means all content, methodologies, frameworks, templates, scripts, swipe files, recordings, written materials, and intellectual property delivered as part of the Services.
3. Eligibility
The Services are designed exclusively for senior professionals at Head of and Director level in Australian and New Zealand corporate organisations. To use the Services you must be at least 18 years of age and have the legal capacity to enter into a binding agreement.
By using the Services you represent and warrant that you meet these eligibility requirements.
4. Account Registration
Some Services require you to create an account on the Kajabi platform or other Approached-controlled platforms. You agree to:
Provide accurate and current information when registering.
Maintain the confidentiality of your login credentials.
Notify us immediately of any unauthorised use of your account.
Not share your account credentials with any other person.
You are responsible for all activity that occurs under your account.
5. The Approached Products
5.1 The Audit
The Audit is provided at no cost ($0). By taking The Audit you agree to receive your audit result and the associated email follow-up sequence. You may unsubscribe from email follow-up at any time.
The Audit produces a numerical score and a tier recommendation based on your responses. The audit recommendation is informational and does not constitute professional advice. Any subsequent engagement with Approached requires your separate decision and purchase.
5.2 The Positioning Report
The Positioning Report is provided at no cost ($0). It is delivered on a first-come basis, subject to Cheraine's available time. Approached reserves the right to limit, defer, or decline The Positioning Report requests where capacity is exceeded.
To receive The Positioning Report you must provide access to your LinkedIn profile and resume in the format requested. The Positioning Report is a personalised review and recommendations, not a rebuild or implementation service.
5.3 The Early Approach Newsletter
The Early Approach is a free email newsletter. By subscribing you agree to receive the newsletter and occasional related communications. You may unsubscribe at any time using the link in any newsletter email.
5.4 The Playbook
The Playbook is a self-paced six-module course delivered through the Kajabi platform. It includes:
Six modules of methodology and instruction.
The Approached asset kit (templates, trackers, scripts, swipe files).
The 30-day execution plan with daily action cards for Week 1.
The "It's not working by Day 14" troubleshooting card.
Twelve months of Monday check-in emails.
Twelve months of access to the recordings library.
The Approached 30-Day Conversation Guarantee.
The Playbook is self-paced. Cheraine does not provide live time, 1:1 review, or personalised feedback as part of The Playbook engagement, except as set out under the 30-Day Conversation Guarantee.
Founding-member price of 1,000 AUD applies to the first 100 buyers. Once 100 founding-member places are claimed, the price increases to 1,500 AUD. Founding-member status confers no additional benefits beyond the discounted price.
5.5 The Cohort
The Cohort comprises The Playbook (with all inclusions listed in clause 5.4) plus:
Weekly 1-hour live group sessions with Cheraine for the duration of the cohort.
Async chat with senior peers for the duration of the cohort.
Recordings of every live session, available within 24 hours.
Cheraine's review of buyer-submitted positioning, LinkedIn, target list, and outreach work in real time during the cohort.
Cohort length, schedule, and capacity are set out at point of purchase. Cohorts typically run for 8 weeks of live sessions with 12 months of access to materials and recordings. Cheraine reserves the right to adjust schedule, capacity, or session timing where reasonably necessary.
5.6 The Advisory
The Advisory is a 1:1 done-with-you engagement comprising:
A 90-minute kickoff call with Cheraine, scheduled within 5 business days of payment.
Position rebuilt with Cheraine.
LinkedIn rebuilt by Cheraine, delivered within 5 business days of the kickoff call.
Resume rebuilt by Cheraine, delivered within 5 business days of the kickoff call.
Target list of 20 organisations and 80 named decision-makers, with one-page intelligence on each.
Outreach drafted in your voice, ready to send.
Ninety days of follow-up cadence run by Cheraine on your behalf.
Senior conversations booked directly on your calendar.
The Approached 30-Day Conversation Guarantee, plus the additional rebuild-at-no-cost guarantee specifically for The Advisory.
The Advisory requires your active participation. You must attend the kickoff call, sign off on each rebuilt deliverable within 5 business days of receipt, and attend the conversations Cheraine books on your calendar. Failure to participate may delay or prevent delivery.
6. Payment Terms
6.1 General
All prices are in Australian Dollars (AUD) and inclusive of GST where applicable.
Payment is required at the time of purchase, except where the instalment plan applies (see clause 6.2).
Payment is processed through third-party payment providers. By providing payment information you authorise the charge of the agreed amount.
6.2 The Advisory Instalment Plan
The Advisory may be purchased on an instalment plan with breakdown of payment at checkout.
By selecting the instalment plan you authorise automatic charges to your nominated payment method on the scheduled dates. You are responsible for ensuring sufficient funds are available on each instalment date.
If an instalment payment fails, Approached will:
Attempt to reprocess the payment within 3 business days.
Notify you by email and provide a 7-day grace period to update your payment method.
If payment is not received within the grace period, suspend further service delivery until payment is restored.
If payment is not received within 14 days of the original due date, treat the engagement as terminated by you. All deliverables and materials provided to that point remain with you under the licence in clause 9. No refund of prior payments applies.
6.3 Late Payment
Where payment is overdue, Approached reserves the right to suspend access to the Services until payment is restored, charge reasonable late fees consistent with Australian Consumer Law, and pursue debt recovery through standard commercial channels.
7. Refund Policy
The Services are non-refundable.
The work begins immediately upon engagement. The Playbook starts the moment you log in. The Cohort starts at the next live session. The Advisory starts the moment your kickoff call is scheduled. Substantial preparation, strategy, and skilled work begin from these moments.
In place of a refund, the Approached 30-Day Conversation Guarantee applies. See clause 8.
If you are unsure whether the Services are right for you, take The Audit first. The Audit is free and provides a diagnostic plus tier recommendation before you commit to a paid engagement.
This clause does not exclude, restrict, or modify any rights you have under Australian Consumer Law or other applicable laws that cannot be excluded or limited.
8. The Approached 30-Day Conversation Guarantee
8.1 The Standard Guarantee (applies to all paid Services)
If you have completed the work as set out in your purchased Service, including all required activities and benchmarks, and you do not have at least 10 senior conversations underway with target decision-makers by Day 30 of your engagement, you are entitled to a 30-minute audit call with Cheraine at no additional cost.
To claim the guarantee you must:
Have purchased one of The Playbook, The Cohort, or The Advisory.
Provide evidence of your work completion and outreach activity.
Submit your claim by email within 14 days of Day 30 of your engagement.
8.2 The Advisory Layered Guarantee
In addition to clause 8.1, The Advisory carries the following further guarantee:
If you are not receiving conversation responses within 30 days of your rebuilt LinkedIn profile going live, provided you have applied strategically to a minimum of 10 relevant companies and the relevant contacts as advised, using the materials Approached has delivered, the engagement will be rebuilt at no additional cost. This includes new positioning, new LinkedIn, new resume, new target list, and new outreach.
You retain ownership and use of all materials delivered, regardless of whether the layered guarantee is exercised.
9. Intellectual Property
9.1 Approached Intellectual Property
All Materials provided as part of the Services, including but not limited to course content, methodology, frameworks, templates, scripts, recordings, written content, audio content, video content, and the Approached method itself, are the intellectual property of Approached and Cheraine, protected by Australian and international copyright, trademark, and other intellectual property laws.
9.2 Your Limited Licence
By purchasing a Service, Approached grants you a personal, non-exclusive, non-transferable, revocable licence to access and use the Materials solely for your own personal career-development purposes. You may:
Access and use the Materials within the platforms provided.
Make personal copies of templates, trackers, and downloadable resources for your own use.
Apply the methodology to your own career positioning work.
You may not:
Resell, sublicense, redistribute, share, or otherwise transfer access to the Materials to any other person.
Reproduce, copy, or republish the Materials in any form for any commercial purpose.
Use the Materials to create competing products or services.
Remove copyright, trademark, or other proprietary notices from the Materials.
Train any artificial intelligence model on the Materials.
9.3 Buyer Deliverables
Materials specifically created for you as part of The Advisory (including your rebuilt LinkedIn copy, your rebuilt resume, your target list, and your outreach scripts) are yours to use, retain, and modify as you see fit. You retain ownership of these deliverables and may use them for your own career-development purposes indefinitely.
Approached retains the right to use anonymised versions of these deliverables for case-study, training, and educational purposes, subject to your prior written consent in each case.
10. Acceptable Use
You agree not to:
Use the Services for any unlawful purpose or in violation of any applicable laws.
Attempt to gain unauthorised access to any portion of the Services, accounts, or systems.
Share, distribute, sell, or republish any Materials in violation of clause 9.
Reverse engineer, decompile, or attempt to extract the source code of any platform on which the Services are delivered.
Use any automated means (bots, scrapers, etc.) to access the Services or extract Materials.
Interfere with or disrupt the operation of the website or the Services.
Use the Services to harass, threaten, defame, or otherwise harm any other person.
Misrepresent your identity, qualifications, or experience to gain access to or value from the Services.
Approached reserves the right to suspend or terminate your access to the Services for any breach of this clause, without refund.
11. User-Submitted Content
You may submit content to Approached as part of the Services, including audit responses, intake forms, LinkedIn URLs, resume content, written work, and conversation notes.
By submitting content, you:
Warrant that you have the right to submit it and that it does not infringe any third-party rights.
Grant Approached a limited licence to use the content for the purpose of delivering the Services to you.
Acknowledge that Cheraine may retain copies of the content for record-keeping, service-improvement, and quality-assurance purposes consistent with the Privacy Policy.
Approached will not publish, share, or distribute your submitted content publicly without your prior written consent.
12. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law:
Approached does not guarantee any specific career outcome, employment offer, salary level, or hiring decision.
Approached does not guarantee that the methodology will produce results in any specific timeframe other than as set out in clause 8 (the 30-Day Conversation Guarantee).
Approached is not a recruitment agent, employment placement service, or career counsellor. Approached is a coaching, cohort, and advisory service.
Approached does not provide legal, financial, or tax advice. You should obtain independent advice on these matters.
Hiring outcomes depend on market conditions, employer decisions, geography, sector dynamics, your own preparation and execution, and other factors outside the control of Approached.
Nothing in this clause excludes, restricts, or modifies any consumer guarantees or rights you have under the Australian Consumer Law.
13. Limitation of Liability
To the maximum extent permitted by law:
Approached's total aggregate liability to you in connection with the Services, however arising, is limited to the total amount you paid Approached for the relevant Service in the 12 months preceding the event giving rise to liability.
Approached is not liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to loss of income, loss of opportunity, loss of data, or loss of business goodwill.
Approached is not liable for the acts or omissions of third parties, including third-party platforms (such as Kajabi, the audit platform, payment processors, and email-delivery services).
This clause does not exclude or limit any liability that cannot be excluded or limited under the Australian Consumer Law.
14. Indemnification
You agree to indemnify and hold harmless Approached and Cheraine from any third-party claim arising from your breach of these Terms, your misuse of the Services, your violation of any applicable law, or your infringement of any third-party right.
15. Termination
15.1 Termination by You
You may terminate your engagement with the Services at any time by ceasing use. For paid Services, termination does not entitle you to a refund of fees paid (see clause 7).
For The Advisory instalment plan, see clause 6.2 for the specific consequences of non-payment.
15.2 Termination by Approached
Approached may terminate your access to the Services immediately, without refund, where:
You materially breach these Terms.
You fail to pay fees due (see clause 6.3).
You engage in conduct that is unlawful, harmful, abusive, or otherwise inconsistent with the spirit of the Services.
You misrepresent your eligibility or fail to meet the eligibility requirements in clause 3.
15.3 Effect of Termination
Upon termination, your right to access the Services and Materials ceases immediately. Provisions of these Terms that by their nature survive termination (including intellectual property, limitation of liability, indemnification, and governing law) survive termination.
16. Cohort-Specific Terms
16.1 Cohort Cancellation
If you cancel your participation in The Cohort before the cohort start date, you may transfer to a future cohort within 12 months at no additional cost. Refunds are not available.
If you cancel after the cohort start date, no refund or transfer is available, but you retain access to The Playbook materials and recordings of any sessions you missed.
16.2 Missed Sessions
If you miss a live session, the recording is available within 24 hours. The Cohort experience is designed to work even if you miss occasional sessions, provided you engage with recordings and the async chat.
16.3 Cohort Cancellation by Approached
If Approached cancels a cohort before it begins, you will be offered transfer to the next available cohort or a full refund of fees paid.
17. Confidentiality
Cheraine will not disclose your engagement with Approached to your current or former employers, recruiters, hiring leaders, or any third party, except where:
You give explicit written consent.
The Privacy Policy permits disclosure (e.g., to service providers necessary to deliver the Services).
Disclosure is required by law or court order.
The Approached methodology teaches you to do your own outreach. Your engagement with Approached remains private. Your current employer cannot tell you have engaged with Approached unless you tell them.
18. Modifications to These Terms
Approached may update these Terms from time to time. Updates will be posted on the website with the revised "Last Updated" date.
For paid Services already purchased, the Terms in effect at the time of purchase apply for the duration of your engagement, unless updated Terms are required by law.
Continued use of the website or Services after changes are posted constitutes acceptance of the revised Terms.
19. Privacy
Your personal information is handled in accordance with the Approached Privacy Policy, available at approached.au. By using the Services you also agree to the Privacy Policy.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria, Australia, for the resolution of any dispute arising out of or in connection with these Terms.
21. Dispute Resolution
If a dispute arises between you and Approached, you agree to first contact Approached in writing using the contact details in clause 26 to seek a good-faith resolution.
If the dispute is not resolved within 30 days of written notice, the parties may pursue the dispute through the courts of Victoria, Australia, or through alternative dispute resolution as agreed.
This clause does not prevent you from accessing any complaint mechanism available under the Australian Consumer Law or other applicable laws.
22. Force Majeure
Approached is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of god, natural disasters, pandemics, government actions, internet or platform outages, or other force majeure events.
Where a force majeure event materially affects delivery of the Services, Approached will work in good faith with you to reschedule, defer, or otherwise adjust the engagement.
23. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable.
24. Entire Agreement
These Terms, together with the Privacy Policy and any specific agreements signed for The Advisory, constitute the entire agreement between you and Approached in relation to the Services. They supersede any prior agreements, representations, or understandings.
25. Notices
Any notice required under these Terms must be in writing and sent to Approached at the contact details in clause 26, or to you at the email address you provided when registering or purchasing.

These Terms have been prepared based on current Australian commercial and consumer law as at April 2026. Australian Consumer Law contains statutory rights and protections that apply regardless of the terms set out above.
